The path of Albania towards the European Union necessitates legal,
institutional and political reforms. Therefore, Albania is involved in intense legal
and political debates to lay sound legal foundations and prepare for the new
European reality. Company law among other fields of law is undergoing major
changes. This article focuses on the overlapping provisions in Albanian law which
are a result of frequent changes of legislation and the process of compliance with the
acquis. The focal point of this work is to shed light on the provisions defining the
law applicable to companies adopted by two different pieces of legislation, both
enacted as efforts to approximate the domestic legislation with European Union law.
